在刚刚结束的法院听证会上,马萨诸塞州地区法官Allison Burroughs宣布美国政府与哈佛和麻省理工学院达成协议,撤销了此前制定的在美国际学生必须在美必须至少上一门面对面课程的新政。

哈佛和麻省理工联合全美十七个州学校以及其他大科技公司对美国政府提告,请求法院政府新政无效。

哈佛大学已经在秋季施行全网课模式。而麻省理工施行的是网课和面对面授课混合的模式。他们在诉状中提出,美国政府制定的针对国际留学生的政策将对经济有巨大影响。国际学生在美国的创新产业中扮演了重要的角色。另外,如果施行此政策,“美国将损失由国际学生每年贡献的上百亿美金。”

原告也承认,尽管在部分学生的国家有时差、网络、军事冲突等等问题,理论上国际学生可以在家乡上网课。

2020年7月6日美国海关和移民总署在官方发布新的关于2020年秋季学期非移民持有F1/M1学生签证的学生上网课的新规定(点击链接),具体内容如下:

第一,非移民,持有F1或者M1签证的学生,如果所就读学校仅开设网课,将不能留在美国境内。移民局也不会给这些学生发放签证,学生也不能进入美国境内。现在在美国境内的学生,如果你的学校今年秋季学期只开设网课,那么你必须要离境或者转学去其他提供面对面授课的学校。如果他们不遵守上述规定,将会被强制离境。

Nonimmigrant F-1 and M-1 students attending schools operating entirely online may not take a full online course load and remain in the United States. The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online for the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States. Active students currently in the United States enrolled in such programs must depart the country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status. If not, they may face immigration consequences including, but not limited to, the initiation of removal proceedings.

第二,如果入读学校提供面对面课程,学生遵守现有联邦规定,持有F1签证学生最多只能上一门网课(或者三个学分)。

Nonimmigrant F-1 students attending schools operating under normal in-person classes are bound by existing federal regulations. Eligible F students may take a maximum of one class or three credit hours online.

Nonimmigrant F-1 students attending schools adopting a hybrid model—that is, a mixture of online and in person classes—will be allowed to take more than one class or three credit hours online. These schools must certify to SEVP, through the Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” certifying that the program is not entirely online, that the student is not taking an entirely online course load this semester, and that the student is taking the minimum number of online classes required to make normal progress in their degree program. The above exemptions do not apply to F-1 students in English language training programs or M-1 students pursing vocational degrees, who are not permitted to enroll in any online courses.

第三,如果学校采用的是混合授课模式(网课+面对面授课),持有F1签证学生可选多于一门网课(或者三个学分),但是学生也必须选修面对面授课课程。

学校必须在开始更改秋季学校授课模式的十天之内在SEVIS系统更新上报采用何种授课方式计划。

另外,如果各所学校在开学时提供面对面授课,然后在将来的某个时间更改授课模式至网课,或者持有F1签证的学生本人最后选择上网课,所有持有F1的学生不准在美国境内只选修网课,必须马上离境或者选择其他方法保持他们的学生身份。

最后,在这份详细的文件里提到了什么情况下才能离开美国回到自己的国家,完全上网课的同时保持合法的在美学生身份:只有那些只提供网上课程不提供面对面授课的学校的在读学生才可以离美全网课的同时保持身份。也就是说,如果你不属于这个类别(即:学校提供了至少一门面对面的课程),离开美国后如果2020FALL全选网课,就会失去合法的学生身份,因此如果你的学校提供面对面的课程,你必须至少选和修完一门面对面课程才能保持合法的学生身份。

For the fall 2020 semester, continuing F and M students outside of the United State, whose schools of enrollment are only offering online classes, may remain in Active status in SEVIS if they are taking online courses and are able to meet the normal full course of study requirements or the requirements for a reduced course of study. Only students enrolled at a school that is only offering online coursework can engage in remote learning from their home country. In this case, DSOs should annotate the student’s record to make it clear that the student is outside the US but taking full time online courses as that is the only choice offered by the school.
